Shopelink is a digital marketplace and classifieds platform that allows, in particular:

• the publication and management of listings by private users and business/dealer users;
• the presentation of business stores or business profiles;
• contact between users through forms, phone, email, contact reveal tools, lead generation, and internal messaging;
• access to premium services, boosts, campaigns, featured placements, and subscriptions;
• access to editorial content, blog articles, informational pages, and SEO content.

Unless expressly stated otherwise for a specific service, Shopelink is not a party to the contract concluded between seller and buyer, provider and customer, or any other users who make contact through the platform.

Shopelink facilitates publication, visibility, and contact, but does not guarantee that a transaction will be concluded, nor the quality of goods or services offered by users, nor the solvency, identity, accuracy, or reliability of each counterparty.

Certain features require the creation of a personal or business account and the provision of accurate, complete, and up-to-date information.

Users are responsible for keeping their credentials confidential, for the use of their account, and for all activities carried out through it.

Shopelink may require email, phone, KYC, or Business KYC verification and may suspend or restrict accounts in the event of inaccurate information, abusive use, fraud risk, legal violations, or breach of these terms.

Shopelink may offer different account types or plans for private users and business/dealer users.

Features, publication limits, number of listings, photos, videos, business modules, stores, leads, analytics, campaigns, or premium tools may vary depending on the active plan.

If a business plan expires, is not renewed, is cancelled, or is suspended, some business benefits or features may be limited, removed, or reverted to the free plan level or the resulting account status.

Users undertake to publish only truthful, lawful, up-to-date listings that match the selected category.

Texts, images, documents, videos, and any other uploaded content must be lawfully usable by the user, must not infringe third-party rights, and must not be misleading or fraudulent.

Shopelink may apply automatic or manual moderation systems, including pre-publication or post-publication review, risk checks, temporary suspension, rejection, unpublishing, or archiving of a listing.

The publication, promotion, or facilitation of content contrary to the law, public policy, or platform rules is prohibited, including by way of example:

• illegal goods or services;
• weapons, ammunition, explosives, or regulated materials offered without compliance;
• drugs, prohibited substances, or products intended for unlawful use;
• false documents, fake identities, or non-authentic certifications;
• counterfeit products or material infringing intellectual property rights;
• offensive, discriminatory, violent, or hate-inciting content;
• illegal or non-permitted sexual content;
• animals or regulated goods offered without complying with applicable rules;
• illegal services, evasive practices, or fraudulent proposals;
• fake listings, abusive duplicates, spam, or misleading content;
• personal data of third parties published without a valid legal basis or consent.

The platform may make available several contact channels, including forms, email, phone, contact reveal tools, WhatsApp, lead forms, and internal chat.

Users must behave lawfully, respectfully, and appropriately. Spam, harassment, intimidation, phishing, fraudulent payment requests, improper data harvesting, and any misuse of contact channels are prohibited.

Deals concluded outside the platform remain at the risk and responsibility of the users involved.

Shopelink may offer paid services, including business plans, boosts, featured visibility, campaigns, premium slots, or other digital services.

Unless otherwise indicated, prices are shown in CHF. Payments are processed by third-party providers, in particular Stripe and/or PayPal, under their own terms and conditions.

Digital, premium, or promotional services may be activated or start immediately after purchase or payment confirmation. Renewals, cancellations, suspensions, or refunds are managed according to the applicable commercial terms, checkout information, and any mandatory law that may apply.

Each user is responsible for:

• the legality and accuracy of their listings;
• the truthfulness of submitted information;
• respect for third-party rights;
• the lawful use of images, videos, trademarks, and documents;
• compliance with privacy rules and contact rules;
• any tax, commercial, professional, or regulatory obligations that may apply to their activity.

To the extent permitted by applicable law, Shopelink and GAGI SA accept no liability for:

• content published by users;
• the outcome of negotiations, sales, purchases, or relationships between users;
• indirect damages, loss of profit, or loss of business opportunities;
• interruptions, temporary unavailability, maintenance, technical errors, or force majeure events.

Service availability is not guaranteed to be continuous or error-free.

Shopelink reserves the right to monitor, moderate, restrict, reject, suspend, or remove accounts, listings, media, messages, reviews, campaigns, or other content whenever considered necessary for legal, operational, security, Trust & Safety, or platform protection reasons.

User reports may feed moderation queues, risk checks, audit logs, or the opening of Trust & Safety cases.

Reviews must be genuine, relevant, and not manipulated. Any artificial reputation manipulation is prohibited, including fake, improperly incentivized, or defamatory reviews.

Shopelink may moderate, hide, or remove abusive, fraudulent, unverifiable, or policy-violating reviews.

The Shopelink brand, the platform proprietary content, software, design, database, and service structure remain the property of GAGI SA or their respective rights holders.

By publishing a listing or uploading content, the user grants Shopelink a non-exclusive license, adequate in territorial scope and limited to the time necessary to host, display, distribute, and promote such content as part of the service.

Scraping, mass reuse, systematic extraction of data, or structured copying of the platform is prohibited without authorization.

Shopelink may update, modify, suspend, or discontinue features, modules, categories, publication rules, prices, plans, or parts of the platform.

Where appropriate, users are informed of material changes through the website, account area, operational emails, or other reasonable channels.

These terms are governed by Swiss law, excluding conflict-of-law rules.

Subject to any mandatory legal provisions, the competent forum is Lugano, Switzerland.
